3. Governing Law & Jurisdiction

5. Payments, Fees & Charges

5.1 Payment Terms

All invoices are payable within 7 days unless otherwise agreed.
Accepted methods: bank transfer, direct debit, or approved payment gateways.

5.2 Late Payment & Interest

Late payments may incur interest of 5% above the Bank of England base rate.
Non-payment may result in service suspension.

5.3 Domain & Hosting Transfers

If a Client wishes to transfer their hosting or domain services, a release fee applies.
Transfers will only proceed once all invoices are settled in full.

6. Cancellation Policy

6.1 Month-to-Month Services

Clients on rolling monthly services can cancel with 30 days’ notice, sent via email to accounts@kustomdezign.co.uk.

6.2 Refunds

• No refunds will be provided for services already rendered.

• Prepaid services are non-refundable.

6.3 Final Invoices

All outstanding balances must be cleared before final delivery or account closure.

7. Limitation of Liability

Kustom Dezign Ltd is not liable for any indirect or consequential damages.
No guarantees are made regarding SEO, ad performance, or third-party platform changes.
Our total liability is limited to the total paid by the Client in the last three months.

8. Dispute Resolution

Clients agree to attempt resolution via informal communication first.
If unresolved, both parties agree to mediation before pursuing formal legal action.

9. Force Majeure

We are not responsible for disruptions beyond our control, including:

• Natural disasters

• Internet or hosting failures

• Cybersecurity events

• Pandemic-related delays

• Governmental or legal changes

10. Service-Specific Terms

10.1 Website Development & Maintenance

Clients are responsible for supplying timely and accurate content.
We are not liable for outages or issues caused by third-party hosts.

10.2 SEO & Digital Marketing

SEO is based on best practices and cannot guarantee ranking results.
Performance is influenced by third-party algorithms and competition.

10.3 Hosting & Domains

Clients must maintain active hosting and domains.
Downtime caused by lapsed accounts is the Client’s responsibility.

10.4 Google Ads Management

• Google Ads management is billed monthly in advance.

• Each payment covers services for the following month.

• Clients may cancel at any time by emailing accounts@kustomdezign.co.uk.

• If cancellation is received within 7 days of payment, the Client is entitled to an 80% refund.

• No refunds will be issued after the 7-day window.

• Payment of the setup fee constitutes acceptance of these terms and conditions.

11. Changes to These Terms

We may update these Terms from time to time.
The latest version will always be available on our website.
Continued use of our services constitutes acceptance of any changes.
